ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW. AFFIDAVIT OF ELIGIBILITY AND LIABILITY/PUBLICITY RELEASE MAY BE REQUIRED.
1. Eligibility/Entries. The Playoff4Payoff.com "Grand Prize" Contest (the "Contest") is open only to legal residents of the fifty (50) United States or the District of Columbia (except where specifically prohibited by law) eighteen (18) years of age or older and who have reached the age of majority in the State in which they reside (which is eighteen (18) in most states but is nineteen (19) in Alabama and Nebraska and twenty-one (21) in Mississippi), as of the date of entry. Employees of P4P, LLC ("Sponsor") and Playoff4Payoff.com each of their respective affiliates, subsidiaries, parent companies, advertising and promotion agencies, distributors and any entities involved in the creation, development, administration or fulfillment of this Contest (collectively, the "Promotion Entities") and each of their immediate families (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren and their respective spouses, regardless of where they reside) and those living in the household of same (whether related or not) are not eligible to enter or win. Contest is subject to all applicable federal, state and local laws. 2. Grand Prize. One (1) "Grand Prize" will be awarded to the "Winner" in this Contest, consisting of $100,000 USD, provided the Sponsor receives a minimum number of entries equal to 6,000 valid Contest entries. Once such minimum threshold is satisfied, all entries will be eligible to win the Grand Prize, subject to Contest Rules and Regulations. Prizes are non-transferable, with no cash redemptions, equivalents or substitutions except at Sponsor’s sole and absolute discretion. In addition to the Grand Prize, the Sponsor will award a weekly prize to one (1) “Winner” each week in the amount of $5,000 per week during the entire ten (10) week duration of the Contest. The Winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the Prize(s) they receive. The name and amount of any prize awarded to the Winners may be reported for tax purposes as required by law. The Winner must provide Sponsor with a valid social security number before any prize will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of a Winner for the amount of any prize. 3. How to Enter. The Contest begins on or about 7:00 a.m. Eastern Standard Time ("EST") on July 4, 2009 and ends at 5:00 p.m. EST on January 1, 2010 (the "Contest Period"). There are two (2) separate ways to enter the Contest during the Contest Period: (i) Online Entry. During the Contest Period, you may enter the Contest by visiting the website located at www.Playoff4Payoff.com The Website will contain a description of the Contest and a link to the official entry form. Complete the entry form with entrant’s first and last name, gender, date of birth e-mail address and Playoff Solution (as described below) in the indicated fields on the entry form and click the "submit" button. Website customers will also be required to pay a Contest entry fee of $10.00 USD via Pay Pal. Any other form of Internet entry is void and may NOT be accepted. Without limiting the foregoing, use of automated, programmed or like on-line entry method is prohibited. In case of dispute, on-line entries will be declared made by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Proof of identity of the Authorized account holder may be required. Online entries must be received no later than 5:00 p.m. EST on Wednesday each week to be eligible for the Weekly Prize and no later than 5:00 p.m. EST on Saturday to be eligible for the Grand Prize. Sponsor’s Website shall be the official timekeeper for purposes of the Contest. YOUR PROVISION OF PERSONAL INFORMATION ON THE WEBSITE IS SUBJECT TO THE PLAYOFF4PAYOFF.COM PRIVACY POLICY, WHICH CAN BE FOUND AT www.Playoff4Payoff.com and may be used for direct marketing purposes; IF YOU DO NOT FULLY AGREE TO THE TERMS OF THE PRIVACY POLICY OR DO NOT WANT TO RECEIVE DIRECT MARKETING MATERIALS, DO NOT PROVIDE ANY PERSONAL INFORMATION ON THE WEBSITE OR ENTER THE CONTEST ON-LINE. INSTEAD USE THE MAIL-IN METHOD OF ENTRY DESCRIBED BELOW. (ii) Mail-In Entry. Alternatively, to enter the Contest for free, or if you do not wish to enter online and submit to the Sponsor’s Privacy Policy, please enter the Contest via postal mail. To do so, please hand print and fill out a 3x5 card labeled “Playoff4Payoff.com Contest Mail-in Entry” with your full name, complete address including zip code (no P.O. Boxes), daytime phone number, date of birth, e-mail address (if you have one) (all of which must be legible), and Playoff Solution and mail in a first class, business size (#10) postage paid envelope to: P4P, LLC, "Playoff4Payoff.com" Contest, P.O. Box 62327 Ft. Myers, FL 33906. Mail-in entries must be received no later than 5:00 p.m. EST on Wednesday each week to be eligible for the Weekly Prize and no later than 5:00 p.m. EST on Saturday to be eligible for the Grand Prize. Sponsor’s Website shall be the official timekeeper for purposes of the Contest. To protect your privacy, we recommend that you send the 3" x 5" postcard to Sponsor in an envelope. Sponsor will not use personal information obtained through a mail-in entry for direct marketing or other purposes, except in connection with the operation, administration and prize fulfillment of the Contest. (iii) Playoff Solution. The Contest is not a sweepstakes or other game of chance. All entries must be in English and must include a typed or written idea for a college playoff structure which can be applied to Division 1A college football (the “Playoff Solution”). Playoff Solutions must be no more than 500 words for the first entry and no more than 250 words for every subsequent entry. The Contest is only open to entries made in strict accordance with the Official Rules. All valid entries and corresponding Playoff Solutions will be reviewed by a panel of judges consisting of not less three (3) judges to be selected by the Sponsor in its sole discretion. Among the criteria to be considered by the panel of judges are originality, fairness to all Division I – Football Bowl Subdivision teams of the NCAA, ease of implementation and other subjective criteria. All decisions made by the panel of judges panel shall be final and binding on all participants. Entries may be returned by the judges panel for clarification and resubmission. Entries will be considered in the order received. In the event that two (2) or more entries are identical or substantially similar (as determined by the panel of judges in its sole discretion), the later entry received will be rejected and ineligible for any prize. On a weekly basis, the judges’ panel will post a ranking of the top 64 entries that have been received by Playoff4Payoff.com. Any entry made without including a Playoff Solution will be disregarded and not eligible for any prize. The Contest has not been reviewed, endorsed or approved by the NCAA or any particular college football team. By submitting an entry to the Contest, all entrants are affirming their agreement to the Official Rules. 4. Awarding Prizes/Winner Notification. The Contest will begin at 7:00 a.m. Eastern Standard Time ("EST") on July 4, 2009 and ends at 5:00 p.m. EST on January 1st, 2010 (the "Contest Period"). After the end of the Contest Period, no additional entries will be accepted or considered. One (1) Weekly Winner will be selected by the Panel from among all new eligible online and U.S. postal mail entries received during the prior week beginning on Sunday at 12:00 AM EST and ending the next Saturday at 11:59 PM EST. The Weekly Prize will be announced and awarded within five (5) business days following the end of any given weekly period. The Grand Prize will be awarded if, and only if, the Sponsor receives at least 6,000 valid Contest entries. Upon receipt of the 6,000th Contest entry, the Sponsor will post a notice on the Contest website thereby making all valid entries eligible for the Grand Prize. At the end of the Contest Period, the judges panel will post a final ranking of the top 64 entries received as of the beginning of the Contest Period. Thereafter, only the top 64 entries will only be eligible to receive the Grand Prize. After posting the final 64, the judges panel will reconsider all entries included in the list of 64 entries. The Grand Prize winner will be selected from the final list of 64 and announces on the date of the college football national championship game. If a potential prize winner entered online, he/she will be contacted by e-mail ONLY at the e-mail address provided when entering. If the potential prize winner entered via postal mail, he/she may be contacted at the email address included on his/her 3”x5” card, but, if an email address was not included on his/her 3”x5” card, he/she will be notified by mail and/or phone. Any or all prize winners may be required to sign an Affidavit of eligibility, a liability release and publicity release ("Affidavit or Eligibility and Liability/Publicity Release"), to be returned within seven (7) days of date indicated on prize notification materials. If any potential winner fails or refuses to sign and return such Affidavit or Eligibility and Liability/Publicity Release within seven (7) days of the first (1st) notification attempt or if the prize notification is returned as unclaimed or undeliverable to such potential prize winner, such potential prize winner (in Sponsor’s sole discretion) may be disqualified and an alternate may (in Sponsor’s sole discretion) be selected. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules, he or she may be disqualified in Sponsor’s sole discretion, and an alternate potential prize winner may then, in Sponsor’s sole discretion, be selected from remaining eligible entries. Sponsor is not responsible for and shall not be liable for late, lost, damaged, intercepted misdirected, or unsuccessful efforts to notify a potential winner. When a potential winner is contacted, he/she will have a stated period of time within which to respond to the notification, or he/she will be disqualified and his/her prize forfeited, and an alternate potential winner may be selected. 5. Name; Likeness Release. Subject to applicable law, by accepting any prize, the winner of such prize authorizes Sponsor to use and publish (and/or otherwise use for purposes of publicity/advertising/trade/promotion) his/her name, address (city, state), photograph, picture, voice and likeness in any and all media now or hereafter known, worldwide, without additional compensation, notification, permission or limitation of any kind. Entrants agree not to issue any publicity concerning Sponsor. 6. General. By participating, entrant agrees to abide by and be bound by these "Official Rules" and the decisions of Sponsor, including the interpretation of the Official Rules, which are final and binding in all respects. All applicable federal, state, and local taxes apply. Entrants who do not comply with these Official Rules, or attempt to interfere with the Contest in any way, may be disqualified. Entrants and all prize winners agree to release, defend, indemnify and hold harmless the Promotion Entities and their respective officers, employees, directors, parent and related companies, affiliates, subsidiaries, participating theatres, agencies and any other companies participating in the design, administration or fulfillment of the Contest (collectively, “Released Parties”) from liability of any kind or nature for any injuries, damages or losses of any kind or any other costs or expenses resulting from participation in this Contest, or acceptance, possession or use, misuse or awarding of a prize or parts thereof, including, without limitation, any injury, damage death, loss or accident to person or property. The Released Parties are not responsible for any printing, typographical, mechanical, human or other errors in these Official Rules, in the administration of the Contest, in the announcement of the prize winners, and/or in any advertising or other associated promotional materials in connection with the Contest. Further, the Released Parties are not responsible for technical, hardware, software, electronic, network, telephone or other communications malfunctions, errors or failures of any kind, errors in transmission, lost or unavailable network connections, telephone connections, dropped dial-up internet connections, interrupted broadband, cable, or wireless internet connections, cell phone dropped calls, unauthorized human intervention, traffic congestions, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed transmissions which may limit or restrict an entrant’s ability to enter the Contest, including any injury or damage to participant’s or any other person’s phone or other electronic computing or telephone equipment, or other matter relating to or resulting from participation in this Contest. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Contest should any virus, bugs, non-authorized human intervention, fraud or other causes beyond its reasonable control corrupt or affect the administration, security, fairness, operation or proper conduct of the Contest. If, for any reason, the Contest is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right at its sole discretion to cancel, modify or suspend the Contest and select the winner from all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor. In such event, notice will be posted on the Website. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the Contest or the Website or to be acting in violation of these Official Rules. ANY PERSON ATTEMPTING TO DEFRAUD SPONSOR OR IN ANY WAY TAMPER WITH, DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE DISQUALIFIED AND MAY BE SUBJECT TO CIVIL AND/OR CRIMINAL PROSECUTION. 7. Odds. Odds of winning depend on the total number of eligible entries received. 8. Governing Law. Except where prohibited, participants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, the prizes or the selection of any winner, shall be resolved individually, without resort to any form of class action, and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no even attorneys' fees; and (c) under no circumstances will participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages or any other damages other than for actual out-of-pocket expenses, and participant further waives any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the Affidavit of Eligibility and Liability/Publicity Release, or the rights and obligations of participant and/or Promotion Entities in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the STATE OF FLORIDA without regard for conflicts of law doctrine of any jurisdiction. 9. Dispute Resolution. The parties agree that any disputes arising out of these Official Rules shall be submitted to final, binding arbitration conducted in Sarasota, County, Florida, under the rules and procedures contained in the Florida Arbitration Code, as amended, before a single, neutral arbitrator who is a former or retired Florida state or federal court judge with experience in entertainment matters who shall follow Florida law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in Sarasota County, Florida, including an award of costs, fees and expenses incurred in enforcing the award. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Official Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in Sarasota, County, Florida. 10. Removal from Mail List. If you would like to be removed from Sponsor’s mailing list, please notify Sponsor in writing at: P4P, LLC, a Florida limited liability company, P.O. This Web site (“Site”) is developed, operated and updated by P4P, LLC (“P4P”). P4P respects your privacy and is committed to protecting it. This privacy policy (“Privacy Policy”) outlines how we gather and disseminate information and, particularly with respect to your own Personal Information, how you can maximize your control over its disclosure. By using the Site you agree to be bound by all terms, conditions and notices contained or referenced herein as well as in P4P’s Contest Rules and Regulations (“Contest Rules”) and Terms of Service (“Terms of Service”) each of which are included below and incorporated by reference.
P4P may change this Privacy Policy and Contest Rules at any time by posting revisions to the Site, and your continued use of the Site indicates your agreement to the revised terms. Accordingly, you should check this document and the policies herein from time to time to keep informed of such changes and if you do not agree to the terms of these policies or revisions please do not register as a user or deregister as a user and exit the Site immediately.
1. Information Collected: P4P may collect two types of information: personal information (“Personal Information”) and aggregated non-personally identifiable information (“Aggregated Information”). Personal Information includes information such as your name, user name, address, postal code, telephone number, e-mail address, IP address, age, marital status, income level, education level, intentions, preferences and opinions. We do not collect Personal Information except when you provide it on a voluntary basis. Aggregated Information will include information that is anonymous, such as the type of browser you are using, general non-identifying demographic information and other such non-personally identifiable information.
2. Why We Collect Information: You may be required to register or otherwise voluntarily provide Personal Information in order to access some specific features of the Site or enter a contest or to be provided with a product or service that you have requested. You may choose not to provide the Personal Information, but this may lead to decreased functionality of the Site for you and will prevent us from providing you with certain products or services. However, you can still access and visit many of the Site's features. We also may request you to voluntarily provide Personal Information that is not required to access features of our site. This information enables P4P to make general improvements to the Site, ensures that content standards of certain sections are upheld, enables us to contact prize winners and better serve your specific interests. P4P may collect Aggregated Information through the use of cookies or by other means. 4. Privacy and Children’s Use Guidelines: P4P does not market or direct the Site toward children. Nevertheless it is possible for children, without prior parental consent, to publicly post or distribute Personal Information or any other information which might identify users within chat rooms, forums, message boards or in user groups. P4P encourages parents and guardians to be aware of and to participate in their children's online activities. We will not knowingly register, communicate with or otherwise collect Personal Information from anyone who indicates that they are younger than 13 years old without the prior verifiable consent of their parent or guardian.
5. Third Party Advertising: P4P may use third-party advertising companies to serve ads when you visit the Site. These companies may use Aggregated Information we compile about your visits to this Site in order to provide advertisements on this Site about goods and services that may be of interest to you. Neither P4P nor any third parties will make any attempt to link this anonymous aggregated traffic and other information to the individual visiting our Site. Except as otherwise detailed in this Privacy Policy, information that personally identifies you will be kept strictly confidential. Any third party promotions and offers will only be made available through us on behalf of the third parties.
6. Cookies: When you visit the Site, we or a third-party advertiser may store or recognize some information on your computer in the form of a "cookie" or similar file. "Cookies" are small text files that identify an individual computer's browser entering the Site. They do not pose a security threat to you. No personal information is stored within the cookies. 7. Forums: From time to time the Site may feature forums such as message boards or chat rooms which enable our users to communicate with each other. P4P does not moderate and is not responsible for the content that you or any user posts on any forum on the Site. All information you post in a forum, chat area or message board becomes public information and may be viewed, collected and used by any visitor to the Site, and may expose you to unsolicited messages. This is beyond our control and P4P is not responsible if your information is intercepted. We recommend that you do not post on any forum private information about yourself or other individuals.
8. Linking Third Party Content/Web Sites: The Site may provide third party content and P4P is not responsible for any such third party content, spoken word or music that you may access through the Site. The Site also contains links from and to sites operated by our business partners and other independent third parties. Once you leave the Site, you may or may not see a new URL in the location bar. Please review the linked site's and third party content provider's privacy policies, and if you do not agree to be bound by the terms of the policies governing that provider and/or site, terminate your use of that service or your visit to the site. The linked sites and those subsequently linked from them are not under the influence or control of P4P and may have their own privacy, data collection and use policies. We are not responsible for the policies, practices or content of sites other than our Site.
9. Security: Any unauthorized use of the Site may result in criminal and/or civil prosecution. P4P has policies and procedures in place to protect the privacy and confidentiality of your information that we collect and maintain, including contracts with third parties that manage the information provided by you. This Site has reasonable security measures in place to protect against the loss, misuse or interception of your information. To help ensure the privacy of your information, we urge you not to share your user name and password with anyone and recommend that you change your password frequently and store it in a safe place. If you are asked to create a user name or password, please select words that do not personally identify you. We may offer "auto login" which allows users to enter member areas of our site without re-entering password information. You may want to disable auto login on your "Set Up" page if you are not the only person using your computer. It is up to you to fully understand the risks and threats of using the public Internet and to be sufficiently aware of those risks to adequately protect your information. P4P’s advice herein is provided as a guideline only, and it is up to the user to remain current and exercise care when using the Internet. 10. Updating/Deleting your Information: P4P enables our users to update/correct personal information, previously submitted, which the user states is erroneous to the extent privacy or security interests will not be compromised by doing so. To update or delete your information, please go to the Log-In function and update or delete your personal information accordingly from our database. Please note that due to backups and records of deletions it may not be possible to delete entirely a user's entry without some residual information remaining.
